Terms of Use

1. Acceptance of Terms

By downloading, installing, accessing, subscribing to, or using the o3IPTV application (“App”) or website, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App or website.

2. Changes to Terms

We reserve the right to change, modify, or update these Terms at any time without prior notice. All changes will be effective immediately upon posting the updated Terms. Your continued use of the App or website following any changes signifies your acceptance of the revised Terms.

3. Description of Service

o3IPTV is subscription-based media player software only. It provides application features for playback, source management, guide-data display, downloads, recording tools, and related software functionality. o3IPTV does not sell, provide, host, retransmit, curate, or include channels, movies, series, live programming, streaming links, playlists, or media content.

Any subscription fees paid to o3IPTV apply solely to software access, software features, updates, and related support services. Users must add and manage only their own lawfully authorized sources. We do not supply third-party source credentials, links, playlists, or media libraries.

4. User Responsibilities and Conduct

  • Lawful Use: You agree to use the App only for lawful purposes and in compliance with all applicable laws and regulations.
  • Authorized Sources Only: You are solely responsible for ensuring that any source, playlist, file, stream, recording target, metadata feed, or guide-data feed you add to the App is lawfully authorized for your use.
  • No Infringement: You agree not to use the App to infringe, facilitate infringement of, or evade restrictions relating to any copyright, trademark, or other intellectual property right.
  • User Responsibility: We do not review, endorse, warrant, or guarantee the legality, availability, accuracy, or appropriateness of any user-added source or media. You assume all risk for any source or media you choose to access through the App.

5. Intellectual Property

All trademarks, logos, and service marks displayed within the App are the property of their respective owners. You agree not to use or reproduce any such intellectual property without explicit permission.

6. Disclaimer of Warranties

The App and related services are provided on an “as is” and “as available” basis without any warranties of any kind, whether express or implied. To the fullest extent permitted by law, o3IPTV disclaims all warranties, including, without limitation, warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components, or that any third-party source or metadata used by you will remain available or lawful.

7. Limitation of Liability

Under no circumstances shall o3IPTV, its owners, directors, employees, affiliates, or partners be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, data, or other intangible losses, arising from:

  • Any use or inability to use the App or website, even if advised of the possibility of such damages;
  • Unauthorized access to or alteration of your transmissions or data;
  • Any conduct, media, source, or data provided by any third party; or
  • Any other matter relating to the App or website.

Your exclusive remedy for any dissatisfaction with the App is to discontinue its use. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

8. Indemnification

You agree to defend, indemnify, and hold harmless o3IPTV, its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the App or website;
  • Your violation of these Terms;
  • Your infringement, or infringement by any third party using your account, of any intellectual property or other right of any person or entity; and/or
  • Any claim that your use of the App or website caused damage to a third party.

9. Arbitration and Waiver of Class Actions

Any disputes arising out of or relating to these Terms or the use of the App shall be resolved exclusively by binding arbitration in accordance with the rules of the American Arbitration Association. By agreeing to these Terms, you waive your right to participate in any class action lawsuit or class-wide arbitration.

10. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and o3IPTV regarding the use of the App and supersede all prior or contemporaneous communications and proposals.

11. Assignment

o3IPTV may assign or transfer these Terms, in whole or in part, at any time without notice. You may not assign or transfer these Terms without our express written consent.

12. Termination

We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, for conduct that we deem to be in violation of these Terms or otherwise harmful to other users or the App.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which o3IPTV operates, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.
